Jury convicts Framingham town critic of assaulting officer Friday, May 30, 2008

FRAMINGHAM -- A vocal critic of town government and the police force was convicted yesterday of striking a local police officer in June 2007.

Following more than an hour of deliberations, a six-member jury found Harold J. Wolfe, 58, guilty of grappling with Officer Greg Reardon during an early-morning argument on Speen Street on June 15, 2007.

Framingham District Court Judge Paul F. Healy Jr. sentenced Wolfe to one year of unsupervised probation and fined him more than $800 for assaulting the officer.

Prosecutor Jennifer Snook had asked Healy to impose a year's probation, 100 hours of community service and a $1,000 fine. Wolfe's attorney, Matthew McGrath, urged Healy to reduce the fine.

In their testimony, Reardon and Wolfe agreed on most of the details of their encounter, but varied on how the argument started and the nature of the assault.

Reardon told jurors he had spotted Wolfe around 3:45 a.m. walking south on Speen Street not far from the all-night Mobil station. The officer said he pulled over and asked Wolfe if he was all right.

Reardon said Wolfe refused to identify himself or say where he lived. Wolfe, of 65 Delmar Ave., Framingham, was arrested after scuffling with Reardon over a small voice recorder Wolfe had pulled out to record their argument.

"I have every right to refuse (to identify myself). I was walking down the street, I was not committing a crime. I wanted to be left alone," Wolfe, a retired software engineer, testified.

The two disagreed on Wolfe's first response - Reardon quoted Wolfe as saying, "Leave me alone," while Wolfe testified that he replied, "I'm fine."

Wolfe told jurors he regularly walked for about 3<+>1<+>/<->2<-> miles each morning, stopping at the all-night Dunkin' Donuts on Rte. 30. He said police questioned him about a dozen times during his early-morning jaunts.

Reardon said Wolfe had his hands in his pockets, and when the officer told him to show his hands, Wolfe pulled out a small voice recorder and a flashlight.

Wolfe, who testified he was tired of police inquiries, told Reardon he was being recorded and continued doing so over Reardon's objections. Wolfe's recording was played by the prosecution, and Wolfe could be heard saying, "I don't have a name," at least three times.

Wolfe also told the officer he had an "attitude" and called him "an idiot."

"I'm walking, and I don't know who I am," Wolfe said on the recording.

Wolfe said he demanded Reardon's name. The officer pointed his flashlight to the name tag on his uniform, according to testimony. Wolfe stepped to within two feet of Reardon to look at the tag. When Reardon tried to move Wolfe's recorder away, Wolfe's hand hit Reardon's forearm as he tried to break free, according to testimony.

"He grabbed my wrist and held it tightly," said Wolfe. "My natural reaction (was) to pry his thumb loose, and I brushed him on the way up."

Wolfe said the contact was accidental. Reardon said he was trying to push away the recorder when Wolfe struck him on the arm. Reardon said he then decided to arrest Wolfe.

Wolfe was not confrontational during his arrest and booking at police headquarters, Reardon said.

In her closing argument, prosecutor Snook said Wolfe broke the law when he grappled with Reardon, now a Framingham Police detective.

"He hit the forearm of Detective Reardon," Snook told the jury. She said Wolfe was "playing games" with Reardon as the officer questioned him.

In his closing, McGrath said his client reacted without thought when he slapped at Reardon. The lawyer said Reardon could have left Wolfe alone for a few minutes to see whether he would enter the Dunkin' Donuts instead of confronting him. He asked the jury whether they believed Wolfe intended to pick a fight with Reardon, then 28, and a police officer with nearly 10 years' experience.

"Mr. Wolfe is not on trial here for being a jerk. He's not on trial here for not cooperating with police," said McGrath, who noted there is no state law requiring pedestrians to identify themselves to police if they have committed no crime and are walking on public property.

Wolfe is a long-time opponent of tax overrides in Framingham. He runs Web sites called A Better Framingham and No More Overrides. He has criticized police, schools and other agencies in town, including the Southern Middlesex Opportunity Council. He is also an opponent of illegal immigration.

In the 2004 town election, Wolfe won more than 1,300 votes for the selectmen race, but lost out to incumbents Charlie Sisitsky and Ginger Esty.

Following the verdict, McGrath said he would discuss with Wolfe whether to file an appeal.

Wouldn't it be important to have a NAME of this individual, in case a few cars or a home were burglarized during the time frame this man was out walking in the area (while the rest of the world is sleeping)? What if a rape had just occurred, and the victim had not yet reported it? Apparently our system of checks and balances does not meet Mr. Rizoli's standards. Mr. Wolfe was approached by a professional police officer because he was in a business district at 3:30 in the morning. The Officer was performing his duty by asking a simple question. The Officer's intent appears to have been to identify Mr. Wolfe for many reasons to include possible criminal activity or simply to check on the well-being of Mr. Wolfe. The very odd response by Mr. Wolfe initiated the event which led to Mr. Wolfe assaulting the Officer. Mr. Wolfe was brought before the Court and was defended by an attorney, rights and protections enjoyed by all. The criminal case was presented by the Government to a jury of Mr. Wolfe's peers. Mr. Wolfe's peers found Mr. Wolfe guilty.

Mr. Rizoli's comments, if actually forwarded by Mr. Rizoli, are silly. The law is very clear regarding assault and battery. "The intentional touching of another person, without having any right to do so, and EITHER causes physical harm OR did so without the consent of the person touched". The additional comments about the Officer being brought to the hospital are meaningless and are not deserving of comment. If Mr. Rizoli is concerned about the law, there is a process to address those issues through our legislators. We will continue to provide professional police service to our community even for those who are ignorant to the law.

I think this case had a very fair decision. Have any of you ever heard of Alzheimer's Disease or dementia? These people are usually confused and can be combative at times in some cases. How many of our elderly citizens have gone missing from their homes during the night and day in this town. And how many normal citizens go out for a walk at that time of morning who are of normal mind set? The Police are just doing their jobs. The Voice Of Reason

Most of you people posting here are being ridiculous just as Wolfe was on the night of the incident. Yes, I don't always like what the cops do. Yes, they do push the limits of their authority sometimes. However, if they see someone walking down the street at 3:45 AM I'd say that would give them probable cause to stop and see what's going on. All Wolfe had to do was say his name and tell the cop he was fine and everything would have been ok. Instead he decides to be a jackass and look where it got him. He now has a criminal record. It may have even been a felony conviction. This is a more than someone just walking down the street. The fact that it was 3:45 AM makes things a little bit different. Nobody likes being stopped by the cops but any reasonable person knows that you should comply with an officer's lawful directions. It doesn't seem unreasonable to me for them to stop someone at 3:45AM. It seems to me that the officer's primary concern was to be sure everything was OK and not to bust the guy's chops. My .02

Clearly, Harold (the Public Figure) is known by the Police department for his stands of fiscal responsibly to the Tax Payers of Framingham. Clearly, Harold has walked the same route for over a decade and stopped and questioned over 12 times by Police. Clearly, Harold carries a voice recorder for reasons of personal safety and as a reminder. Clearly, the officer was intimidated by the recorder. Clearly, there is enough to file an appeal and clearly, the Police have harassed Harold for his criticisms of the police Department. It's just a wonder, Harold wasn't shot dead in his tracks for having a recorder. Only If this verdict is overturned in an Appeal and/or a jury awarded civil suite, will Harold be able to walk Speen Street free from harassment.

Probable cause? Walking down the street is now a suspect activity?

He did tell the cop he was fine. The cop wanted to know Wolfe's name and where he lived. No law requires us to identify ourselves to the police. Reardon was not enforcing the law. He was enforcing his own agenda and should be reprimanded for his unlawful, unprofessional behavior by the Chief.

Reardon's insistence to know the man's name and address was not a "lawful direction." Reardon is a young, cocky cop. How come the other 12 times Wolf was stopped, the officers left him alone when he told them he was o.k.? Reardon's lack of common sense and discretion created the conflict. We don't need the police wiping our noses and tucking us in at night.

If you think Harold has a chance of winning an appeal, you are crazy. Who is wasting taxpayer money now Harry? All you needed to do was identify yourself and say you were going for a walk. It would be over. but no, you have to be the big man who stands up to the officer with the gun.

I've only skimmed the earlier postings, so forgive me if I'm repeating. Now Det. Reardon was 28 one year ago, yet has 10 years police experience. Can this be true? Do we hire police officers almost directly out of high school? (Does MWDN ever fact check?)


To Law Enforcement Professional By that definition of assault, didn't the cop assault Wolfe first? Wolfe was not breaking any laws, he simply refused to surrender his rights, which apparently upset Reardon. When Reardon grabbed Wolfe's wrist in an attempt to take away his recorder, that is when Wolfe supposedly attacked Reardons forearm. Why does the law allow a police officer to assualt a law-abiding citizen but now allow the citizen to defend himself from the assualt?


Wolfe in sheep's clothing

I'm a big supporter of law enforcement, but the officer may have mishandled the situation. It would have been one thing is the officer had reasonable suspicion to stop Wolfe. Had he tried to hide, changed direction, was carrying tools that could be used to burglarize, had a pillowcase of stuff slung over his shoulder, had a bloody axe, etc. There is no law against walking down the street in the middle of the night, and Harold was under no obligation to identify himself if the officer did not give a valid reason for asking for ID. However, Wolfe did made the situation worse by refusing to answer a reasonable question "Sir, are you all right?" had he simply said "I'm ok, I'm just walking home" that probably would have been an end to it. Putting your hands on an officer is never acceptable, and I guess that's the bottom line. FYI - Harold, pullling out a tape recorder is just going to tick the police off. Spend a few extra bucks and get one of those hats with the hidden camera in it!


What if...

People pulled their heads out of their butts. The cop did the right thing, what if the old coot had OldTimers is was out wondering around aimlessly? What if the officer didn't do his job and this old coot gets creamed by a Boston Globe paper truck? Then his family sues the city and then Baron, Rizoli, and the rest of the left wing nuts taxes go up....and they cut the police force....and crime goes up. Or Harold could have simply answer the question in a civil manner and been on hit way.....

I have to agree about the police officer being out of line. I feel that once the officer asked if the man was alright and their was no probable cause to go any further then he should have just let the guy go on his merry way and minded his own business. I feel there are many of them who take advantage of their position in life and many are bullies. Cops are supposed to be an example and some of them are the complete opposite. One thing no one has even mentioned is the notation that he has done this early wak routine many times and been very cooperative. maybe the thirteenth time was the one that broke the camel's back. do the cops ever talk to one another? a 58 year old man escapimg on foot? come on. You know, you brought up a very important point. Authorities are being enabled to do whatever pleases them. Habeas Corpus, in some instances CAN INDEED BE DENIED. That's perfectly legal! The cop knew who Harold was and was harassing him. Harold gave it back to him and the cop didn't like it.

Most the cops know Harold takes that walk so it was no surprise to them to see him walking. Reardon was just throwing his macho cop attitude around. There are some people in the town tha WILL NOT put up with police harrassment. Harold is one of them and the Rizoli's are another. If they spent their energy on going after the illegal aliens things would be great but the don't. Some of the cops like harassing American citizens, because we're an easy target and they know where we live.

First off, getting rid of the 9 and 1 from my telephone would hinder making many more useful phone calls than say to 911. Secondly when I hear a bump in the night I'll investigate it myself instead of hiding under my covers dialing the station waiting for some gestapo cop to "assist" me. If my power goes out I think I'll call NStar since I don't think too many of Framinghams finest are licensed to work on fixing power outages. Third, if I am ever raped, robbed or assaulted I'll be sure to contact Framingham's Time Machine Task Force so they can go back in time to stop this awful event from affecting my life. I will however be consulting them on when the fresh batches of donuts and other delectable pastries become available at all of the towns premier Dunkin Donuts locations.


Frustrated with Broken System

I was hassled by a cop for no reason one time and ended up being arrested for "disorderly conduct". The judge dismissed the case at the arraignment but now I seem to get pulled over all the time and treated like a serial rapist when I do. I know the cops are just running my plate for no reason. They see I have been arrested (even though the case was dismissed) so they decide to harrass me. Is there anything I can do to get this off my record, Ive never been targeted/profiled like this before..I am an upstanding citizen that just wants to be left alone!

What would have happened if the officer actually got hurt real bad? One of the 1st things that police are taught when confronting an individual on a street is to make sure he keeps the person's hands in plain view. Since this person did not comply with a simple order of keeping your hands out of your pockets he is subject to arrest.

I like Framingham too, but I'm not too happy with the corruption and the invasion of illegal aliens who are coming here to commit their crimes. The Framingham police have their hands full and I sure can sympathize with them. They must feel really frustrated having to deal with all the wacko's here. Framingham is a big magnet for all the crazies.That being said, the police also have some serious attitude problems on how they deal with people in general and I've made several complaints to Chief Carl, and he knows what's going on.

I'm told the police force is divided on what should be done in Framingham so a divided police force is not a good thing for the town. If the police could unite and start doing their job and go after those here illegally and set a good example, Framingham will get back on track. As it stands now we as a town are sinking fast with no relief in sight, as they are a sanctuary "city" for illegals. This town will never be revitilized as long as this problem is still going strong.

You live in California? My goodness That state has been taken over by illegals, so you must be able to relate. Seems to me you went from the frying pan into the fire.

Detective Reardon is one of the finest human beings I have ever met. Several years ago, I was leaving the Senior Citizen Center and began feeling dizzy. I pulled over and this young handsome officer approached my vehicle and asked me if I was ok. I told him that I was a diabetic and that my sugar was low. This sweet officer ran next door and then ran back and saved me. He is a hero. He treats the elderly so well. Shame on you Harold for being so naughty. God bless you, Detective Reardon.

The cops have attitude because we work in an era where we get no respect. When I grew up you just said yes sir and walked away from the police If you didn't they brought you home and your parents kicked your a**. Today the parents get mad at the cops. Jim, Harold, I woud love to have the two of you come out an ride with me for a few days and see what we deal with on a daily basis and how we must bite our tongue because we are cops. probable cause only applies when the Officer is conducting a criminal investigation. This investigation was initially a well being check because an older man was walking at night and answered a simple question with the type of answer that would raise a question in the mind of an experienced police officer. This entire conversation was recorded. Did the officer say or do anything out of line? No. Did Mr. Wolfe say anything or do anything out of line. Yes. Has anyone ever been hit in the face with a tape recorder? I'm sure many police officers have. But not Officer Reardon. Officers are hit, spit on, harassed, demeaned every day. How often does a police officer lose his temper. Harold, move to Iraq.

It's simple...

1) A man was walking down the street. This is legal.
2) He was carrying and using a voice recorder. This is legal.
3) The police officer asked him to turn if off. He didn't. This is legal.
4) The man refused to identify himself. Since he is not being accused of a criminal act, this is also legal.
5) The police officer grabbed the man's wrist and held on. This is *NOT* legal since the office had no evidence that the man had committed any crime.
6) The man apparently accidentally brushed the officer's arm while trying to free himself from being illegally held. Ain't that a friggin shame.
Somebody want to tell me why this guy didn't counterclaim assault from the officer?
The whole "why not just cooperate" attitude bugs me. Simple - because you don't have to! Why not just let the police search your house on a whim? Because you don't have to!
